Answers to some commonly asked Workers’ Compensation questions:

Is workers’ comp a lawsuit? No, it’s not. The Virginia Workers’ Compensation Act was passed so that employees injured at their jobs would get prompt, fair compensation if they miss work due to an injury that takes time to heal.

Will workers’ compensation pay me? In general, they should. When you get hurt during the normal course and scope of your job and can’t work because of that injury, workers’ comp insurance is supposed to pay you for both lost wage benefits and the cost of medical treatment. How much does workers’ comp pay per week? That exact figure is calculated based on your wages at the date of your injury. Virginia workers’ compensation pays 66.66% of your average weekly salary, assuming that your claim is accepted by your employer and their insurance company.

How many weeks can I collect workers’ comp checks? The maximum length of time in Virginia is generally 500 weeks, which is more than nine years.
